These Terms of Service ("Terms") govern your use of the PassportToWork website, mobile applications and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Definitions
- "Company", "we", "us" means PassportToWork Pvt Ltd.
- "Worker" means an individual seeking domestic or overseas employment through the Platform.
- "Employer" means a business or individual hiring workers through the Platform.
- "Sub-agent" means a registered partner sourcing workers on behalf of the Company.
- "User" means any Worker, Employer, Sub-agent or visitor.
2. Eligibility
To use the Platform, you must:
- Be at least 18 years of age
- Be legally capable of entering into binding contracts under Indian law
- Provide accurate, current and complete information during registration
- Not be barred from emigration under any law of India or the destination country
3. Recruitment licence and compliance
PassportToWork operates as a Recruiting Agent (RA) licensed by the Ministry of External Affairs, Government of India under the Emigration Act, 1983. We adhere to ILO ethical recruitment standards and comply with applicable destination country labour laws. Our licence number is displayed on the Platform.
4. Worker obligations
- Provide truthful, verifiable information about identity, qualifications, experience and medical condition
- Submit genuine documents — fraudulent passports, certificates or experience letters will result in permanent blacklisting and may attract criminal action
- Attend pre-departure orientation and any medical/skill assessments scheduled
- Honour the employment contract signed with the employer for its full duration
- Inform the Company immediately of any grievance, change in circumstances or contract violation
5. No worker placement fees
In line with ILO ethical recruitment principles, PassportToWork does not charge workers any placement fees for international placements. All recruitment costs are borne by the employer. Workers may be required to bear costs of personal documentation (passport, medical, attestation) which are paid directly to the relevant agencies.
If any person — including a sub-agent — demands a placement fee from you in our name, please report it immediately to our Grievance Officer.
6. Employer obligations
- Provide accurate job specifications, wages, working hours, accommodation and contract terms
- Honour the employment contract and pay wages on time
- Comply with destination country labour laws, occupational safety standards and worker welfare regulations
- Not retain workers' passports or original documents (except where required by law)
- Pay all service fees and recruitment costs as per the agreement with the Company
7. Service fees and payments
Service fees payable by employers are agreed in writing before deployment commences. Invoices are raised per deployment or per agreed milestone. All amounts are exclusive of applicable GST. Payments are due within the period stated on the invoice (typically 30 days). Late payments attract interest at 1.5% per month.
8. Contract between worker and employer
While PassportToWork facilitates the introduction and deployment, the employment relationship is between the Worker and the Employer. PassportToWork is not a party to the employment contract and is not liable for disputes arising from breach of that contract, except as expressly required under the Emigration Act and our recruitment licence terms.
9. Repatriation
Where required by destination country regulations or bilateral agreements, the Company will assist with repatriation of workers in cases of contract completion, medical emergency, employer default, or distress. Repatriation costs are typically borne by the employer per the employment contract.
10. Prohibited conduct
You must not:
- Use the Platform for any unlawful purpose, including human trafficking, forced labour, or visa fraud
- Submit false, misleading or fraudulent information
- Impersonate another person or entity
- Interfere with or disrupt the Platform or its security features
- Reproduce, copy or scrape Platform content without written permission
- Bypass our official application process or pay/receive bribes
11. Intellectual property
All content on the Platform — including text, graphics, logos, and software — is the property of PassportToWork or its licensors and is protected by Indian and international intellectual property laws. You may not reproduce or distribute our content without written permission.
12. Limitation of liability
To the maximum extent permitted by law, PassportToWork shall not be liable for any indirect, incidental, consequential or punitive damages arising from your use of the Platform or from any employment relationship facilitated through the Platform. Our total liability for any claim shall not exceed the service fees actually paid to us in respect of that placement.
13. Indemnity
You agree to indemnify and hold harmless PassportToWork, its directors, officers, employees and agents from any claims, damages, losses or expenses arising from your breach of these Terms or your violation of any law.
14. Termination
We may suspend or terminate your account at any time, without notice, if you violate these Terms, provide false information, or engage in conduct harmful to other users or the Company. You may close your account at any time by contacting us, subject to retention of records required by law.
15. Governing law and jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, India. Workers may also approach the Protector of Emigrants and statutory grievance bodies for matters within their jurisdiction.
16. Changes to these Terms
We may modify these Terms at any time. Updates will be posted on this page with a revised "Last updated" date. Continued use after changes constitutes acceptance.
